ICT permits - What exactly does the equal treatment principle mean?
The equal treatment principle means that an employee sent to Germany on a deputation contract must be treated equally to the local empoyee with the same qualifications.
The following criteria have to be considered, when evaluating working conditions:
-
- Applicant to receive a salary which is equivalent to what an employee within the German company would receive;
- Applicant not to be offered worse working conditions than the working conditions in the German entity;
- Applicants to have the same holiday rights than local employees in Germany;
- Applicant to get the same additional benefite (car etc.).
