Are there diffenent types of ICT permits?

There are two different types of ICT permits. The choice of which ICT permit apply fordepends of the intended duration of the stay, since one is for more and the other for less that 90 days.

There are two types of ICT permits:

1. ICT permit for a stay of less than 90 days;

2. ICT permit for a stay of more than 90 days (and up to 3 years).

The maximum duration of a stay on an ICT permit is 3 years.

The main requirements to obtain an ICT permit for both types are:

  • Applicant to be a specialist for the relevant job to be carried out in Germany;
  • Applicant to have a pre-employment period of at least 6 months with the foreign company entity;
  • Applicant to be deputed within a company group, so from a foreign company entity to the German entity of the same company Group;
  • Applicant to remain on the foreign company's payroll for the period of deputation (instead of receiving a full employment contract with the German entity);
  • Applicant to have the intention to return to his home country work place once the secondment is terminated;
  • Applicant to receive a salary which is equivalent to what an employee within the German company entity would receive;
  • Applicant not to be offered worse working conditions than the working conditions in the Germany entity.

An ICT permit requires the approval of the German labour authorities.
