An ICT permit application procedure consists of various steps. The first step is the collection of a pre-approval from the German authorities. This article describes how to initiate this pre-approval collection procedure with Dwyer Legal.
An ICT work permit visa procedure contains of 3 steps:
- The collection of the assignee specific work permit pre-approval document from the German labor authorities (which is to be requested on behalf of the German company entity and processed by Dwyer Legal),
- the filing of the visa application with the Germany consulate in the assignee's home country (to be processed by the assignee and based on the obtained pre-approval)
- the conversion of the entry visa into the long term residence permit, once the assignee has arrived in Germany (to be processed by the assignee in assistance of Dwyer Legal).
To initiate the pre-approval collection procedure, the following documents and information need to be provided to Dwyer Legal:
General Documents:
- Fully filled work pemrit request form
Employee specific documents:
- Copy of employee's passport (first page only);
- Dwyer Legal work permit application form (Excel sheet will be provided by Dwyer Legal);
- Copy of employee's University Degree (if available);
- Copy of employment contract with Indian company entity;
- Copy of deputation letter for Germany;
- Work permit application form EBV (Erklärung zum Beschäftigungsverhältnis with attachement Anlage 4);
- Assignee detailed job description for Germany;
- Assignee's CV.
In addition, the company also needs to provide the following once-off documents:
- Documents showing that the foreign company (employer in home country) and the German company are belonging to the same company group (min. 50 % shareholdership in one hand);
- Germany company entity power of attorney to Dwyer Legal (template will be provided by Dwyer Legal).
